How come the mentally ill have never been afforded privilege like the homosexual community?

The US and Canadian mental health system treats the mentally ill like inmates yet the gay community is afforded protection from slurs. Whereas the mentally ill aren't even provided protection from excessive force from officers or hospital staff. Where is the fairness in that?
